AP CLUB TERMS AND CONDITIONS
1. AP CLUB LOYALTY PROGRAMME
1.1 AP CLUB Loyalty Programme (“AP CLUB”) is governed by the terms and conditions set out herein (“Terms and Conditions”).
1.2 The submission of an application for Membership to AP CLUB is deemed to be an acceptance of these Terms and Conditions.
1.3 Upon becoming a Member of AP CLUB, the Member shall be deemed to have agreed to and be bound by these Terms and Conditions.
ELIGIBILITY AND MEMBERSHIP
2. AP CLUB Membership
2.1 There are two types of Membership, namely, AP CLUB Basic Member ("Basic Member"); AP CLUB VIP Member ("VIP Member").
2.2 Any individual aged 12 or above is eligible to apply for Membership as General Member or above upon satisfaction of the corresponding entry requirements as specified under Clause 4 hereinbelow. Minors (i.e. individuals under the age of 18) require the consent of a parent or legal guardian to join AP CLUB. By accepting these Terms and Conditions, the minor confirms that parent or legal guardian’s consent has been obtained.
2.3 The registered name for Membership shall be the same as the applicant’s name in their official identity document and AP CLUB shall have the right to seek verification from the applicant. Each individual is only entitled to have one Membership account at any given time.
2.4 Approval of application for Membership and grant of the relevant Membership shall be at the sole and absolute discretion of AP CLUB. AP CLUB may refuse to approve and grant any Membership without giving any reason.
2.5 Membership, the e-Membership Card and the Benefits are non-transferable and non-assignable and may only be used or enjoyed by that individual Member to whom the Membership, the e-Membership Card and the Benefits are granted or issued.
2.6 AP CLUB may at any time without prior notice review the Membership tiers and the criteria for eligibility to the Membership, or reassign a Member to another Membership as AP CLUB may decide.
2.7 AP CLUB is entitled to modify the structure, benefits, contents and other features of AP CLUB, including but not limited to the AP CLUB Member Portal, the Memberships, the Benefit, these Terms and Conditions, joining programs of or having arrangements with new or other programs and termination of the AP CLUB, at any time without prior notice. Although AP CLUB will use reasonable efforts to notify Members of material changes to AP CLUB and/or to these Terms and Conditions, it is the responsibility of Members to keep themselves up to date in respect of AP CLUB and these Terms and Conditions. AP CLUB will not be liable for any loss or damage resulting from any modifications to AP CLUB, including but not limited to these Terms and Conditions.
2.8 Each Member will be assigned a Membership account. Members must ensure that their Membership account details including but not limited to the password, Membership number, as well as any QR codes representing their Membership are kept confidential and are not disclosed to any parties. Member is fully responsible for any use of their Membership account by any persons and AP CLUB shall not be liable in the event that a third person obtains access to a Member’s account to make transactions, whether with or without authority of the Member.
2.9 AP CLUB shall have the right to audit a Member's account at any time without prior notice to ensure compliance with these Terms and Conditions, any terms and conditions of the partnership, and any other applicable rules, regulations, or terms. During the audit, a Member’s account may be temporarily suspended, and the Member may not be permitted to access their account or perform any transactions.
3. E-MEMBERSHIP CARD
3.1 AP CLUB will issue an e-Membership Card to Members upon their successful application. AP CLUB、Art Piece and/or the partnership are entitled to request Members to present their e-Membership Card when they claim for any Benefits, register their spending, or make any request in relation to their Membership, the e-Membership Card, the AP Points and/or the Benefits.
3.2 Without prejudice to the right of AP CLUB to seek verification under Clause 2.3, AP CLUB、Art Piece and/or the partnership are entitled to assume without proof that the bearer of an e-Membership Card is the Member named thereon.
4. MEMBERSHIP ENTRY REQUIREMENT
4.1 Basic Member
4.1.1 Any individual who satisfies the membership entry requirements as may be specified by AP CLUB from time to time is eligible for application for Membership. Membership for Basic Member has a lifetime validity period unless terminated pursuant to these Terms and Conditions.
4.1.2 If a customer or Basic Member makes any transaction spending at Art Piece and/or the partnership, they are eligible to register such spending.
4.1.3 AP CLUB shall have the right to terminate the Membership of a Basic Member anytime if the Basic Member does not satisfy any of the conditions within the period specified by AP CLUB (if any). Upon such termination, AP CLUB is entitled to cancel all Accumulated Spending of such Basic Members and will not include the same for the purpose of calculating the Benefits.
4.2 VIP Member
4.2.1 If the accumulated spending of a Member at Art Piece reaches HKD3,500 within a consecutive 12 months, they will be eligible for an upgrade to VIP Member.
4.2.2 If a Basic Member fails to fulfil the upgrade requirement within the specified period, the Accumulated Spending record will be forfeited and will be re-calculated for another consecutive 12 months upon the next transaction.
4.2.3 Upon upgrading from Basic Member to VIP Member, all previous accumulated spending will be reset to zero.
5. REDEMPTION AND ENJOYMENT OF BENEFITS
5.1 A Member may only claim benefits at designated locations specified by AP CLUB, which is entitled to make the final decision on such benefits.
5.2 All Benefits are offered subject to availability while stocks last (if applicable).
5.3 AP CLUB is entitled to grant Benefits to Members only when the Membership account is valid and in good standing as recognised by AP CLUB.
5.4 Once AP CLUB has accepted any redemption request from a Member, the redemption request by the Member cannot be changed or cancelled.
5.5 A Member shall forthwith inform AP CLUB of any Transaction where Benefits have been obtained/redeemed but such Transaction is subsequently cancelled, refunded or reversed for whatever reasons. In such circumstances, or if the Member fails to inform AP CLUB but it has come to the knowledge of AP CLUB of those cancelled, refunded or reversed Transaction(s), the Member shall pay to AP CLUB forthwith upon notice from AP CLUB for the value of the Benefits, which shall be determined by AP CLUB in its sole and absolute discretion.
5.6 AP CLUB、Art Piece and/or the partnership are entitled to request Members to present the e-Membership Card and, if necessary, other identification documents for verification of identity when the Member claims for any Benefits.
6. TERMINATION OR SUSPENSION OF MEMBERSHIP
6.1 Members may terminate their Membership at any time by giving written notice to AP CLUB.
6.2 AP CLUB is entitled to forthwith terminate or suspend the Membership of any Member in case the Member breaches any of these Terms and Conditions or does not comply with the instruction of AP CLUB. In addition, AP CLUB shall have the right to forthwith terminate or suspend the Membership of any Member at any time at the sole and absolute discretion of AP CLUB without any reasons or compensation. AP CLUB shall not be liable for any loss or damage resulting therefrom suffered by any party in any circumstances.
6.3 Termination of Membership for any reason shall not prejudice any accrued rights and remedies of AP CLUB、Art Piece and/or the partnership as at the date of termination.
6.4 If there is any misuse of, amongst others, the e-Membership Cards, QR codes, Membership accounts or Benefits, AP CLUB、Art Piece and/or the partnership shall have the right to terminate or suspend the Membership or withdraw the Benefits from the Member without prejudice to any accrued rights and remedies of AP CLUB、Art Piece and/or the partnership against the Member.
6.5 Upon death of a Member, their Membership account shall be closed and all Accumulated Spending (if any) shall be cancelled by AP CLUB without any compensation.
7. GENERAL CONDITIONS
7.1 AP CLUB shall deal with all personal data in accordance with the Personal Data (Privacy) Ordinance of the laws of Hong Kong and Art Piece’s Privacy Policy Statement. Please refer to the Privacy Policy Statement here: https://artpiecehk.com/en/pages/privacy-policy.
7.2 A Member shall consent to the Personal Information Collection Statement of Art Piece during the application for Membership which sets out the privacy policy and practices of Art Piece in respect of its collection, holding and use of personal data in relation to AP CLUB.

7.4 AP CLUB shall have the right and discretion to amend, delete, modify and/or vary any of these Terms and Conditions, including but not limited to imposing additional terms in respect of the Membership, the e-Membership Card, the Accumulated Spending, the Benefits and other matters in relation to AP CLUB from time to time without prior notice. Should there be any inconsistencies between these Terms and Conditions and those additional terms and conditions, those additional terms and conditions shall prevail.
7.5 AP CLUB is entitled to transfer, assign, charge, sub-contract or otherwise dispose of any of the rights or obligations under these Terms and Conditions and AP CLUB on such terms and conditions as AP CLUB may at its sole and absolute discretion think fit at any time without any prior notice to the Member.
7.6 AP CLUB is entitled to amend, suspend and terminate AP CLUB at any time without any prior notice, reason or compensation. AP CLUB shall not be liable for any loss or damage resulting therefrom by any party in any event.
7.7 All parties agreeing to these Terms and Conditions do not intend that any term of these Terms and Conditions should be enforceable or enjoyed, by virtue of the Contracts (Rights of Third Parties) Ordinance (Cap 623 of the Laws of Hong Kong), by any entity or person who is not a party to these Terms and Conditions. The consent of any entity or person who is not a party to these Terms and Conditions is not required to rescind or vary these Terms and Conditions.
7.8 AP CLUB has the right to interpret these Terms and Conditions and its interpretation shall be final and binding on all parties concerned.
7.9 The Chinese version of these Terms and Conditions is provided for reference only. In the event of any discrepancy between the English version and the Chinese version, the English version shall prevail.
7.10 These Terms and Conditions shall be governed by the laws of Hong Kong and any disputes arising from, out of or in relation thereto, shall be subject to the exclusive jurisdiction of the Hong Kong courts.
